Representation for Victims of Accidents and Injury
If you’ve experienced a serious accident or injury, you know it can forever alter your own life and the lives of your loved ones. The process involved in recovering compensation for your medical bills and lost wages while in the midst of receiving medical care can be overwhelming and impossible. Regardless of whether it’s a minor collision or a slip and fall on a frosty walkway, if somebody is harmed in a mishap it’s often another person who is to blame.
A lawsuit attempting to prove liability for an accident is known as a negligence claim. The injured party (plaintiff) is responsible for filing the claim against the party thought to be at fault (defendant). It’s up to the plaintiff to prove each of the following five elements in order for a claim to be successful:
- Duty: The defendant owed to a duty of care;
- Breach of Duty: The defendant failed to meet that duty of care;
- Cause in Fact: But for the defendant’s failure, the plaintiff would not have been injured;
- Proximate Cause: The defendant’s failure (and not something else) caused the plaintiff’s injury; and
- Damages: The plaintiff has actually been injured and suffered some loss.
The law surrounding these elements can be complicated and the facts may be difficult to prove. While the success or failure of a negligence claim will depend on the specific circumstances of the case, the peace of mind that comes from working with an outstanding attorney cannot be over emphasized.
